Employee settlement agreement advice in Pembrokeshire

Is there an ongoing conflict involving you in your workplace?

Are you worried about losing your job and how that may impact your finances?

Has your employer offered you a settlement agreement?

PATHWAY LEGAL CAN HELP YOU!

OUR STORY

PATH began in 1978 by community figures who wanted to help those who were struggling.

At this time, local businesses were vital to helping the organisation. For example, Lloyds Bank offered a free banking service and Tenby Press provided logo and stationary.

Additional help was also provided by the headmaster of Greenhill School, Manager of the Esso refinery, and the head of the catering department at Pembrokeshire College.

‘’Big oaks from little acorns grow’’

The initial plan was to raise £1,000 through wine and cheese nights, but the organisation also received donations from Lloyds Bank, Esso Oil, Merthyr Trust, and food vouchers from Tesco and Co-op.

The project began with one part timer (Libby Burns) who was provided with a clipboard, a few sheets of paper, a biro, and what passed for a mobile phone in those "far off days."

THE HOUSING PROBLEM

The problem back then was very similar to the situation today.

Landlords required bonds, was difficult to afford at the time (£20, equating to around £250 per person today). The money used for the bond was only repaid if no damage was done to properties, and it was returned to the Bond Fund. However, landlords kept claiming ‘’damage’.

This caused a shortage of cash and was resolved by starting an inventory of new tenants and keeping pictures of the flat when the tenants moved in.

Originally it started with single people and couples, but soon became increasingly difficult when incorporating families. As the years went by, the organisation developed more experience in helping families successfully into accommodation.

Pathway Legal can provide advice and representation to employees who have been offered Settlement Agreements by their employers.

For a Settlement Agreement to be legally binding and enforceable the employee must obtain advice from an independent solicitor.

A Settlement Agreement provides a clean break for both parties, providing protections and assurances that each party adheres to what has been agreed, as well as ensuring the details of what has been agreed remains confidential.

If your employer has offered you a Settlement Agreement, then we can provide you with legal advice and representation.

SETTLEMENT AGREEMENTS

Where it is not possible to continue in your employment or mediation is not a suitable option, then we want to help you to get the best outcome that allows you a fresh start.

It is common for employers to offer employees a Settlement Agreement as a means to resolving a variety of issues in the workplace without resorting to costly and unpredictable litigation. The employer offers a Settlement Agreement and related benefit, payment and reference in exchange for the employee agreeing to resign and also agreeing not to bring any claims against the employer. Settlement Agreements are voluntary, and the employee does not have to agree or accept any Settlement Agreement that is offered by the employer that they are not satisfied with.

Pathway Legal can advise on the content and legal implications of the Settlement Agreement as well as any financial incentives that are included in the agreement and any post-termination restrictions and confidentiality clauses. This service is available to individuals who live or work in Pembrokeshire. There is no cost to the employee as your employer will cover the cost of our service as part of the agreement. We can usually complete this work in just a few days.

If you are an employer who proposes to offer your employee a Settlement Agreement, then we can act for your employee in this matter to ensure a quick, smooth and fair process for all.

We regret that we cannot act for any employers in settlement agreements but will be happy to make a recommendation of an alternative legal service provider.

MEDIATION IN THE WORKPLACE

If there is a desire on both parts to resolve an ongoing dispute rather than end the employment, we can also offer workplace mediation through Pathway Mediation. Most workplace conflicts can be adequately resolved when both parties proactively engage in workplace mediation.

We can help to facilitate a productive dialogue to resolve workplace issues and lead to a more harmonious working environment. Mediation can take place either at the workplace or at one of our offices, and we also offer online mediation via Zoom.

Our mediation service is paid for by the employer and is a voluntary process. For more information on mediation please visit out Pathway Mediation website.
